Day 4: Inside ICE Detention Centers
As fear permeates the country, ICE detention centers are being flaunted as a solution to a nationwide problem, and yet most Americans do not understand what ICE detention means or looks like. A recent report titled Cold Reality: Uncovering the Cruelty and Chaos of ICE Operations in Pennsylvania reveals alarming practices by Immigration and Customs Enforcement (“ICE”) within the state. Jointly released by the American Civil Liberties Union (“ACLU”) of Pennsylvania, the Farmworker Legal Aid Clinic at Villanova University Charles Widger School of Law, and the national ACLU, the report highlights systemic issues and abuses in ICE’s operations that disproportionately affect vulnerable communities like undocumented persons in Pennsylvania.
The findings are based on an analysis of nearly 2,500 I-213 records—forms used by the Department of Homeland Security to initiate deportation proceedings—obtained through Freedom of Information Act (“FOIA”) litigation. These records represent a sample of over 16,000 documents prepared by ICE in Pennsylvania between 2016 and 2020, providing a stark picture of the agency’s systemic issues.
The report details a pattern of targeting specific demographics, particularly Latin American men of color employed in low-wage jobs, indicating racial and economic biases in enforcement actions. Additionally, the report sheds light on the disturbing prevalence of family separations, with nearly one-third of all Pennsylvania ICE arrests analyzed involving the intentional separation of children from their parents. Such actions not only violate human rights but also inflict long-term trauma on families and communities.
Another critical issue outlined in the report is ICE’s collaboration with local law enforcement agencies. This cooperation often leads to unlawful arrests and detentions, misuses local resources, and fosters a climate of fear within immigrant communities.
Vanessa Stine, senior staff attorney for immigrant rights at the ACLU of Pennsylvania and a co-author of the report, emphasized that these abuses are not isolated incidents but systemic features of ICE’s operations. She reaffirmed that all individuals, regardless of immigration status, are entitled to equal rights under the U.S. Constitution. Caitlin Barry, director of the Farmworker Legal Aid Clinic, noted the harmful impact on workers, stating that immigration enforcement enables workplace exploitation and harms all workers’ rights.
The Cold Reality report highlights the urgent need for reforms to protect the rights and dignity of immigrants. It calls on local governments to end collaborations with ICE, cease the operation of detention facilities, and implement measures to safeguard immigrant communities from exploitation and abuse.
